Terms of Service

1. These terms

These terms govern your use of the Source/Record platform, operated by Source/Record TV Ltd. By creating an account or using the service you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

2. The service

Source/Record provides tools for post-production teams to process multitrack audio - speaker-aware transcription, a voice registry, search, clip assembly and exports for the edit, and a story assistant. What is available depends on your licence and on the settings chosen by your production's managers, and we may add further tools to the service over time.

3. Accounts and security

Keep your account details accurate and your credentials confidential. You are responsible for activity under your account. Where your company requires two-factor authentication, you must enrol a factor to reach its productions. Tell us promptly if you suspect unauthorised access.

4. Your content and the rights you need

You retain all ownership of the material you upload and everything produced from it. You grant us only the limited licence needed to host and process that material to provide the service, acting as your data processor under our data processing agreement.

You are responsible for having the rights and lawful basis to process the material you upload. In particular, enrolling a voice creates biometric data, and you must have the contributor's explicit consent - the platform records a consent affirmation, but the responsibility for obtaining it is yours.

5. Acceptable use

You agree not to:

  • upload material you have no right to process, or use the service unlawfully;
  • attempt to access another customer's data, probe or circumvent the platform's security, or disrupt the service;
  • use the service to impersonate a person without their consent or to create deceptive or harmful content;
  • reverse-engineer the platform or resell it without our agreement.

6. Our intellectual property

The platform, its software, interfaces and the configuration of the models behind it are ours or our licensors'. These terms grant you the right to use the service, not any ownership of it.

7. Fees

Paid features are provided under a licence quoted to your company. The licence is bought as a quantity of channel-hours - one recorded hour on one microphone - paid up front, and it carries no per-person charge. Fees, allowances, the period for which material is retained, and any offers are as set out in your order or licence. Payments are handled by our payments provider.

8. Availability and warranties

We work to keep the service available and correct, but it is provided “as is”. To the extent permitted by law, we do not warrant that it will be uninterrupted or error-free, and results such as transcription and speaker identification are best-effort and should be reviewed before you rely on them.

9. Limitation of liability

Nothing in these terms limits liability that cannot be limited by law. Subject to that, neither party is liable for indirect or consequential loss, and our total liability is limited as set out in your order or licence agreement.

10. Term and termination

Either party may end the arrangement in line with your licence. On termination we stop processing and delete your data within 30 days, save where we must retain something to meet a legal obligation. Provisions that by their nature should survive - ownership, confidentiality, liability - do.

11. Changes

We may update the service and these terms. Where a change materially affects you, we will give reasonable notice. Continuing to use the service after a change takes effect means you accept the updated terms.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless your order states otherwise.
